BERT SAMUELS ON THE DPP CASE FI KARTEL

A charge of prosecutorial misconduct is being directed at government lawyers as the appeal hearing for Vybz Kartel (real name Adidja Palmer) and his co accused got underway in the Court of Appeal this morning.

Attorney Bert Samuels raised concern that the jury was allowed to deliberate despite the fact that one juror tried to bribe other members of the panel.

Mr. Samuels argued that Director of Public Prosecutions Paula Llewellyn advised the trial judge not to discontinue the case, despite knowing that the jury was tainted.

He argued that the DPP was prepared to have the appellants tried by a jury that was not transparent.

Mr. Samuels further argued that the DPP has a duty to ensure that all accused are tried by an impartial jury.

He said the DPP also failed to use her powers to ensure that justice was delivered in the case.

The Court of Appeal ruled last week that it will accept four new pieces of evidence in the case.

Palmer, a popular dancehall artiste, is appealing the life sentence imposed on him in 2014 for the murder of Clive “Lizard” Williams.

Three other men – Shawn Campbell, Andre St. John and Kahira Jones – were also convicted for the murder.
