There was a major development in the case involving three members of the Jamaica Defence Force, charged with the murder of Chartered Accountant Keith Clarke, with the defence now claiming immunity against prosecution in court on Monday.
Their trial was scheduled to get underway, but at the start of the sitting attorneys for the three soldiers submitted certificates which purport to grant them immunity from prosecution.
The immunity was reportedly granted to the JDF soldiers on February 22, 2016 by former National Security Minister Peter Bunting.
Attorney Paul Beswick, who is representing the three soldiers, Greg Tinglin, Odel Buckley and Arnold Henry, raised a preliminary point declaring that the certificates protect the soldiers against prosecution.
The certificates were issued by the National Security Minister under the Emergency Powers Act.
The documents were served on the Director of Public Prosecutions last week.
In the document, Mr Bunting stated that he was granting the soldiers immunity because they were acting in good faith in the exercise of their duty, for public safety and the restoration of public order, when Mr Clarke was fatally shot at his East Kirkland Close residence on May 27, 2010.
Justice Glen Brown is now hearing submissions from Mr Beswick.
