Bail granted: Man charged with raping man, woman, children
JOSIAH KYLE NICHOLAS has been granted $175,000 bail on charges of false imprisonment, grievous sexual assault and two charges of robbery.
He will however remain in custody as he was denied bail on other charges, including kidnapping sexual touching and buggery of a 12-year-old boy, when he appeared before the Port of Spain earlier this week.
Nicholas will also remain in custody as the Arima magistrate said she wanted his address verified before a condition of the $175,000 bail is imposed.
On Friday, Nicholas appeared before senior magistrate Gillian Scotland at the Arima Court.
She read the four charges which were allegedly committed against two victims.
It was alleged that he robbed and falsely imprisoned a 27 year old man against his will and that he robbed and committed grievous sexual assault against a 37 year old woman.
He was not called upon to plea to the indictable charges.
The auto mechanic was represented by attorney Shiva Boodoo who asked for reasonable bail. He told Scotland that his client had convictions for driving without a driver’s permit and insurance. He also admitted that Nicholas who had his learner driver’s permit, had four pending matters for traffic offences.
Scotland placed Nicholas on the bail with the condition that he reports to a police station. Boodoo asked that this station be in Arima but the magistrate requested proof of the address in Arima before the conditions imposed. This information is to be given at his next court appearance on June 6.
They included common assault, robbery with aggravation, kidnapping, false imprisonment, sexual touching and the buggery of a 12-year-old boy, driving without a driver’s permit or insurance, and possession of a firearm. Five charges pertaining to the Arima area were also read to him on that day.
They included grievous sexual assault, kidnapping, false imprisonment, robbery with aggravation, and buggery against an 18-year-old. These are to be transferred to Arima.
Nicholas is due to reappear before the Port of Spain court on May 24.
