POLICE CONVICTED OF KILLING GIRLFRIEND APPEAL DENIED

Former policeman Linval Aird has lost another round in his bid for freedom, after being convicted in July for the murder of a female friend in April 2010.

The Court of Appeal this week rejected his application for bail pending the appeal of his life sentence for the killing of Shauna-Kaye Clarke.

Clarke was shot dead in Westmoreland.

Aird was found guilty and sentenced in July this year in the Westmoreland Home Circuit Court, however, shortly
after he filed an appeal.

He also applied for bail while this appeal should be heard.

The Court of Appeal in its judgment this week, lamented that the transcript for the trial was not yet ready.

It therefore had to rely on the information on the court’s case file, in addition to submissions from Aird’s Attorney-at-Law and the DPP’s Office.

In his bail application, Aird contended that he would be successful at trial because the transcript will reveal he did not get a fair trial. He alleged that the Judge did not treat him fairly and scientific evidence would prove his innocence.

The former cop argued that he was not a flight risk and could abide by bail conditions while his appeal was heard, as he was previously on bail and complied with the conditions.

However, the Court of Appeal stated that it could not thoroughly consider whether these allegations were true without examining the transcript of the trial which is still not yet available.

The Court noted that it was only in exceptional cases that bail would be granted after a conviction while the appeal was being heard, but it could not be established based on what was before it, that this was such a case.
