The Jamaica Public Service Company (JPS) has lost its battle to collect billions of dollars from its customers following a big payout to its workers.
This followed a reclassification exercise which concluded in 1990.
The UK-based Privy Council on Thursday rejected the appeal of the power company.
In 2015, the JPS took its fight to the Privy Council after the Office of Utilities Regulation (OUR) and the local courts denied its application to recover more than $4 billion from its customers under the Z-factor.
Following a lengthy wage dispute with the National Workers Union, in May 2008 the utility company agreed to make a net payment of $2.3 billion in back-pay to its employees.
With salary adjustment, the figure rose to more than $4 billion.
In March 2009 JPS filed a Z-factor submission which sought the OUR’s approval for the company to recover the $4.3 billion.
The following year the OUR dismissed the claim.
After hearing the arguments last month, the Board of the Privy Council ruled on Thursday that it agreed with the Court of Appeal in rejecting JPS’ challenge on the 2004 filing issue.

Yes they have to borrow to pay staff, because people like you are stealing electricity or not paying the bill, so light get disconnected every other month. The GOJ owes JPS Billions and of course JPS borrows Billions to upgrade their facilities. Contrary to what you people think, JPS is NOT a very profitable enterprise.
Just go to the rural areas in Jamaica and most houses are wired for electricity, but most are disconnected for none payment of their bill.

Anon 2, jps as well as other compsnies can hardly pay staff without bank loans, i dont need to steal light. I am just stating the facts, i use to work at jps in the accounts dept, so i know most months jps had to take loan just to pay staff. One would think jps would be making billions on top of billions but they waste money so i am not surptised jps wanted us customsrs to pay extra money so they can tske it and pay workers. Jps had to pay us back money which was millionssssss. People like u can go push a big drum down ur throat n shut up if u dont know nothing.
