A PRIMARY school teacher (39) from Buhera who impregnated a Grade Seven pupil (14) pupil did the unthinkable on Monday and drenched the courtroom floor in urine as the State submitted aggravating evidence incriminating him.
Chandaida Mhuka, a teacher at Nechishanye Primary School, Buhera pleaded guilty when he appeared before Chipinge magistrate, Mr Noah Gwatidzo for sleeping and impregnating a juvenile.
In his aggravating submissions for the conviction of the accused, prosecutor, Mr Witness Nyamundaya, said Mhuka deserved a stiff sentence that will serve as a deterrent to would be offenders.
“The accused is a disgrace to the community because as a teacher he failed to live up to the expectation of a role model who is expected to groom and mould children to be exemplary citizens. The accused as the teenager’s teacher really knew the age of the complainant, therefore he committed the offence deliberately to deter her from furthering her education. By so doing he ruined her future,” said Mr Nyamundaya.
“The accused paid fake lobola in an attempt to conceal his crime and this is revealed by the fact that the accused is not maintaining the baby. He is not staying with the victim and therefore there is no love at all,” he added.
The matter came to light after the complainant who is now 16-years-old and a mother of a two-year-old baby approached the courts applying for maintenance for the upkeep of the child.
Circumstances are that on December 3, 2011 at around 1pm and at the teachers’ cottages, the complainant was called by the accused to sweep his room. She went there in the company of her classmates.
While the complainant was sweeping Mhuka’s room, he grabbed her shoulder, but did not say anything.
From that day, Mhuka would buy her sweets and biscuits as well as giving her some money to buy food which she shared with her friend.
On June 22, 2012 at around 7pm, the complainant, in the company of two other schoolmates arrived at Nechishanye Primary School from sporting activities at Nehumambi Primary School. They were in Mhuka’s custody.
The trio were offered a room to sleep since it was late and were also afraid to go alone to their respective homes.
Later on Mhuka went to the room where the girls were sleeping and started fondling the complainant’s breasts. She tried to stop him, but was told to wait and see the end results. He slept with her while the other children were fast asleep.
From there, Mhuka had unprotected sex with the girl on three different occasions with the complainant’s consent. The matter was exposed after the girl’s mother discovered her child’s pregnancy of which the complainant was not aware about of.
The girl’s mother kept on interviewing her about the person who had impregnated her until she implicated Mhuka. In February 2013, Mhuka paid the girl’s relatives $260 in the absence of her mother which was said to be the teenager’s lobola.
He should get the full length of the law because he ruined this young girl’s future. On top of that, he is not even maintaining the child.
