PRINCIPAL OF MORANT BAY HIGH GIVEN BACK HIS JOB DESPITE NEGLECTING HIS JOB

Dalton Shaw, who was fired from his job as Principal of Morant Bay High School three years ago, has secured a major victory in his bid to be restored to his job.

The Supreme Court on Thursday declared that his termination by the board was null and void.

This has cleared the way for him to return to the school.

Mr. Shaw was fired in 2014 after being charged by the school board with Neglect of Duty, Professional Misconduct, as well as Improper Conduct.

He went to the Teachers’ Services Commission to challenge the decision. The Commission upheld the decision.

Mr. Shaw then went to the Supreme Court, and last year obtained an Order which prevented the school from appointing a new principal until his application for Judicial Review was heard in court.

The Supreme Court heard his application and, in a consent judgment on Thursday, declared that he is effectively the school’s principal, because the procedure used to terminate him was flawed.

The court ruled that the personnel committee which recommended his termination was improperly constituted and the decision of the Board to uphold its ruling was null and void.

It also ruled that the decision of the Board of Morant Bay High to vote for his termination was null and void because one of the persons who voted was not a member of the board.

The judgment now means that Mr. Shaw is free to return to the school and resume duties as Principal.
