A 36-year-old Chitungwiza man who was caught having sex with a minor in a barber shop has escaped jail.
The man who slept with a 15-year-old girl was ordered to perform 315 hours of community service. Between September 5 and October 5, Colleen Zanga of, Chitungwiza asked to have a sexual relationship with the girl, who is of the same age with his first born daughter, and she accepted.
The two had consensual sex on several occasions. Appearing before Chitungwiza magistrate Mr Kudakwashe Jarabini, Zanga pleaded guilty to having sex with an under age girl.
Mr Jarabini sentenced him to 12 months in prison and set aside three months on condition of good behaviour. The remaining nine months were commuted to community service at Seke 3 High in the same location.
In his defence, Zanga told the court that the girl lied that she was 16-years-old, a claim she also admitted when she was giving evidence.
Agreed facts were that on September 5, Zanga went to the girl’s home and they had sex outside the premises.
On another day, the two also had sex inside a barber shop at the girl’s home with her consent. The court heard that on the third time, she was left in custody of her neighbour and Zanga visited her and had sex with her again.
They had sex on several occasions until October 5 when they were caught red-handed by passers-by during the act. The girl’s brother reported the matter to the police leading to Zanga’s arrest.
